As an educator or adviser working within or with a private or independent school, you know that many of the laws applicable to publicly funded educational institutions don’t apply to you, and yet, you face many of the same challenges, plus more. It is critical that you have a clear understanding of the laws that govern you and the best practices that should guide your actions.

Developed in consultation with private & independent school operators/owners/associations as well as lawyers representing private & independent schools, this comprehensive day will look at the usual school law issues from this different perspective, while also addressing those issues unique to private and independent schools, including:

  • Who can enroll a student? Do both parents need to be on the contract? What happens when families separate/divorce and there are no rulings on paper about custody?
  • Admissions requirements – can it be refused when there is no entrance exam?
  • Collecting tuition – can report cards/transcripts be held back when tuition is outstanding?
  • What are the laws around ending a contract or expelling a student?
  • The rights of non-custodial parents
  • Fundraising – what are the applicable laws?
  • Duty to accommodate special needs students – what’s the standard?
  • Field trips & incident reports – what permission forms are required? Best practices?
