The program offers a rare opportunity to increase counsel’s effectiveness in handling personal injury/tort cases at mediations. Expert counsel and mediators will explain and demonstrate key aspects of advocacy in mediations, including: what makes for a winning mediation brief, handling bad behavior and difficult personalities, impact of cross-cultural factors on the mediation, and creative ways of overcoming impasses.

Other areas covered include:

  • Taking full advantage of the opportunities presented by the mediation brief
  • Establishing and maintaining your credibility with the mediator
  • Tactics the other side will use and how to counter them
  • Getting a failing mediation back on track, using the mediator as your key resource
  • Ethical and professional issues arising throughout the process

Expert counsel and mediators will illuminate and demonstrate key aspects of mediation advocacy.

“A very well-conceived program designed to arm a litigator…with basic and advanced skills for mediation as well as an understanding of some of the more nuanced aspects of mediation strategy”
Jayashree Goswami, Zurich Canadian Holdings Ltd., participant in OsgoodePD’s earlier version of this program
