On December 10, 2015, Quebec’s assisted death law came into effect. The rest of Canada isn’t far behind, with federal legislation expected on June 6, 2016. Where are we at, and what can we expect in the future?

In its landmark decision Carter v. Canada, the Supreme Court of Canada unanimously struck down the ban on physician-assisted suicide, giving the federal government one year to draft legislation. Our experts will explore the far-reaching implications of this case and the proposed legislation on those involved in the health care sector. Benefit from unique insight and lessons learned from Quebec as it has worked to overcome challenges implementing the new assisted death legislation. Whether you are a health law practitioner, management or counsel working in health care institutions, long-term care or retirement homes, or a licensed medical professional, you will benefit from this thoughtful and practical discussion about the changing landscape of end of life care. Topics include:

  • Where are we now? The state of physician assisted death in Canada
  • Update on consultation hearings held by the Special Joint Committee on Physician-Assisted Dying
  • Legislative initiatives proposed by the federal government
  • Canada Medical Association’s response to Carter
  • Implications of draft guidelines proposed by the provincial Regulatory Colleges
  • Assisted death: a medical, ethical or legal decision?
  • Real world challenges when implementing physical assisted death practices  – lessons learned from the front lines in Quebec
    • How to manage conscientious objection of health care professionals
    • Where does it happen (e.g. at patient’s bedside, special hospital unit, at home)?
    • Practical challenges in interpreting eligibility criteria (e.g. “unbearable suffering”, “imminent death”, etc.)
  • Practical implications – what your health care institution, long term care and retirement facilities need to be doing now
