The Supreme Court of Canada has recently rendered three landmark decisions that revisit the right to freedom of association under section 2(d) of the Canadian Charter of Rights and Freedoms. The Court’s decisions in Mounted Police Association of Ontario v Canada, Meredith v Canada and Saskatchewan Federation of Labour v Saskatchewan build on the Court’s earlier freedom of association jurisprudence and have significant implications for labour relations in Canada.

The issues considered in this trilogy of cases – including collective bargaining rights and the right to organize, and that section 2(d) includes the right to strike – are need-to-know for anyone working in labour relations.
