Managing legal risk has become much more complex, with increasing pressure to deliver a quality design, in a shorter timeframe, and at lower cost. The risk profile for design professionals has expanded, and you are now routinely called upon to assume risks which may not be insurable. This program is designed to help you assess and mitigate your risk, and to aid you in making more informed decisions that go to the heart of your business and professional reputation.

Design professionals are exposed to numerous risks through the course of a project, including negligence claims and other potential liabilities which can result in heavy financial costs and significant reputational damage. This information-packed program will focus on how to manage the legal and business risks that come with practicing as an architect or engineer. Designed and delivered by some of Canada’s leading legal and industry experts, this program will provide you with tools and practical risk management strategies that can be put to immediate use.

  • Out-gunned – strategies for dealing with large owners, opposing lawyers and numerous contracts/agreements in a tight timeframe
  • The design services contract and managing the RFQ/RFP process: how to protect yourself, and when to walk away
    • Standard form contracts, including RAIC Document Six, OAA 600, OAA 601, ACEC Document 31 and BIM Contract Appendix, IBC 100-2014
    • Key contractual provisions, including standard of care, indemnities, warranties and liquidated damages
    • Risk management and negotiating strategies when concluding contracts
  • Understanding what your insurance covers … and what it doesn’t
    • Insurable vs. non-insurable risk – where is the line?
    • How and when to engage with the insurer
    • Non-insurable business risks – identifying and managing them
  • Managing common areas of liability exposure, including sub-consultant risk, BIM risks and the altered risk profile in Design-Build, P3s and AFPs
  • Dealing with the owner’s custom contract changes – common scenarios and examples
  • Opportunistic deficiency and delay claims – identifying and managing a set up claim
