Canada’s Anti-Spam Legislation (CASL) is one of the toughest and most stringent anti-spam regimes in the world. The penalties can range up to $1 million for an individual and up to $10 million for companies. Understanding CASL and how it is being enforced is critical for all organizations sending messages to and from Canada and that have apps or other software that they may install on users’ computers.

Topics include:

  • Review of enforcement actions under CASL to date
  • Amounts of penalties for enforcement actions under CASL
  • Areas of non-compliance that have led to enforcement action
  • Strategies and tips regarding undertakings and due diligence
  • The Compu-Finder decision and the first application of the “use of address harvesting” provision in PIPEDA
  • The Private Right of Action scheduled for July 1, 2017
