This webinar is part of the Ethics in Administrative Justice: Webinar Series.

While adjudication can be challenging at the best of times, the unique ethical issues that confront many board and tribunal members can be particularly difficult. Referencing real-life examples, topics covered include:

  • Avoiding potential conflicts
    • How soon – if ever- can you preside over a party, legal professional (or law firm/organization) you have (or had) a professional or personal relationship with?
  • Professional and volunteer involvement: when can this be perceived to be a conflict?
  • Accessing additional information: what are the consequences – if any – for adjudicators who undertake their own research?
    • Obtaining outside subject-matter expertise or opinion
    • Searching information in the public domain (ie. Google, Wikipedia, etc.):
      • to get information not provided by the parties?
      • to learn about the parties?
      • to gain context for the issue in dispute?
      • research the law?
  • Effective strategies for obtaining consensus among tribunal/panel members
