Acting with Integrity: Successful Strategies for Advocates Appearing Before Tribunals

Developed to provide clarity on some of the most complex ethical issues that advocates commonly face in tribunal practice, this webinar will provide you expert insight on a range of practical techniques and recommended responses.

There is no single model for adjudicative ethics that is commonly recognized and followed by all tribunals, boards or agencies across Canada, or even within Ontario. This, plus the perception that administrative tribunals are “less formalistic” than courts, creates a lot of uncertainty for advocates in administrative adjudication.

As one of them, you need to be ready to address any ethical dilemma that can arise during the adjudicative process – both to maximize your client’s chances of success, and to ensure that your own professionalism is not compromised.

Topics include:

• Best practices for navigating the tribunal, board or agency
• Strategically (and ethically) building relationships within the tribunal, including adjudicators and tribunal staff
• Appreciating the unique culture within administrative adjudication
• Clarifying your roles and obligations when dealing with self reps
• Counsels’ obligations to client vs. administration of justice
• Managing the under-represented litigant: appreciating the role (and obligations) of counsel in adjudicative proceedings
• When – if ever – should you assist the other side? How is this most successfully accomplished?
• Unbundling legal services and limited retainers: tactics for dealing with the ethical implications these new structures pose
