“97% of all information exists in digital form and more than 80% will never be printed on paper.”

- C. Rothman, Wortzmans

Virtually all matters now involve eDiscovery. With the sheer volume of discoverable electronic information continuing to rise, the demands and complexities involved in the eDiscovery process has increased. At the same time, as a sole practitioner, in-house counsel, associate or partner in a law firm, you’re continually faced with increased demands from your clients on how to maximize efficiency and reduce costs.

Whether acting for plaintiff or defence, or are in-house counsel, implementing effective eDiscovery practices, strategies and tactics result in greater efficiencies and cost reductions. Balancing this with your professional obligation to find – and protect – relevant evidence and pertinent information for your case can be challenging.

A faculty of experts – from both the legal and eDiscovery fields – will take a deep dive into the ethical dilemmas legal professionals encounter when dealing with electronic evidence.

You’ll obtain practical guidance and tools to implement in your practice to ensure your professional obligations are met, and client expectations are exceeded. Topics include:

  • Practice management tools for targeting relevant evidence, thereby reducing time and client costs
  • Strategies to implement for preserving data and avoiding admissibility issues
  • Best practices for protecting privacy and privilege, including technological challenges (eg. spreadsheets, embedded information and metadata)
  • Understanding the differences between privileged vs. confidential information, and the corresponding obligations
  • Knowing who – and when – to call in for help
  • Tactics for handling complex ethical situations – steps to take when in receipt of confidential or privileged information; what to do if you suspect the other party is deleting information
